GENERAL COMPETITION TERMS & CONDITIONS
These terms and conditions apply to all competitions featured during live filmed events, or when included online on the www.youngspeakersaward.co.uk website, facebook and twitter pages.
You accept these terms and conditions when you enter this competition, together with any specific terms for such competition which may be mentioned during live or filmed events, in any messages or on this website (“competition information”). If you do not agree with any of these terms and conditions then you should not enter the competition. If there is any inconsistency between these competition terms and conditions and any such competition information, the competition information shall prevail.
These terms and conditions may be amended or varied at any time without prior notice. Any changes will be posted on this website. It is your responsibility to ensure you review these terms and conditions regularly to familiarise yourself with any changes. We recommend that you print and store or save a copy of these terms and conditions for future reference.
1. Entry Terms for Competition Applicants
1.1 The competition is open to residents of Brighton and Hove City, UK aged between 14-17 yrs on or before the 1st March 2010, unless specified otherwise and must be accepted as one of six participants by and only by one of the listed and eligible schools on this site, unless specified otherwise. Employees, sponsors or volunteers on this project where applicable, are ineligible to enter. Any such entries will be invalid.
1.2 The Promoter reserves the right to ask for proof of age and evidence to verify the identity of an entrant at any time, and may use any channels and methods available to carry out checks of any details provided.
1.3 The opening and closing date and time for entries, is as indicated in the competition information. Any entries received before or after these times will be discounted.
1.4 Entry to the competition must be by the applicable method(s) as indicated in the competition information which may include any of the following:
(i) Web entry: Web entrants are required to follow the instructions on the website as indicated in the competition information. Entrants will receive a message confirming entry to the competition. Web entrants may be required to supply their name, and/or email address and/or a contact telephone number and/or any other details as required on the web entry form.
(ii) E-mail entry: Email entrants may enter the competition by sending an e-mail form with the information indicated in the competition information and at the email address indicated. There is no charge for email entries. Entrants may receive a message confirming their entry to the competition. The Promoter does not accept responsibility for any incorrectly addressed or undelivered entries or for any disruption, delay or misdirection of email entries.
1.5 Any entries which are incomplete, misspelt, inaudible, incomprehensible or which are not in accordance with the competition terms and conditions, or not received by the Promoter will be void. An entry to the competition will be deemed to be an invalid entry where an entrant has evaded payment of the applicable entry charges when entering the competition.
1.6 In the event of any fault, mistake, misunderstanding or dispute concerning the correctness or acceptability of any answers given by entrants, or the operation of any part of the competition, network or phone system, the decision of the Promoter shall be final and no correspondence will be entered into.
1.7 The Promoter will not be liable to reimburse expenses incurred in making an entry where applicable. No refund will be made for the cost of any entry where applicable.
1.8 The applicant or person taking part in the competition agrees to be available to be filmed and photographed on camera during the live events as well as prior or post the event to be used in conjunction with promotion and marketing for the Young Speakers Award Competition.
2. The Prize
2.1 The prize is as specified in the competition information. Where the prize necessitates travel and/ attending an event on a specific date, the winner (and their companion(s) if applicable) must be available on the date(s) specified by the Promoter and no alternative dates will be available. Where the prize involves travel on a date and/or destination, the date and/or destination chosen is subject to availability and the Promoter reserves the right to include a final date by which the prize must be taken. The winner is solely responsible for all insurance, applicable taxes and for any costs, expenses and charges not specified in the prize description in the competition information. The prize is subject to the terms and conditions of the manufacturer or prize provider.
2.2 The process for determining the winner of the prize is as indicated in the competition information. Where the winner is randomly selected, the prize draw for the winner will take place on the date indicated in the competition information.
2.3 The winner may be notified on the day of the event or after the competition date or as soon as practical thereafter, or as otherwise indicated in the competition information. He/she will be contacted by the means provided when entering the competition unless otherwise specified in the competition information. The winner will have a specified fixed time period in which to claim his or her prize. Failure to respond within the fixed time period as specified and/or provide an address for delivery of the prize may result in forfeiture of the prize. If successful contact is not made, or they do not respond within the time specified in the competition information the Promoter reserves the right to offer the prize to the next eligible entrant and thereafter until a winner is found.
2.4 The Promoter may refuse to provide a prize, or seek its recovery, in the event of non-entitlement under these terms or an entrant's breach of these terms, fraud or dishonesty, including but not limited to the use of technology which enables an entrant to evade charges when entering the competition.
2.5 The Promoter reserves the right in its sole discretion to withhold delivery of the prize until such proof of eligibility and identity has been confirmed or to disqualify the entrant from the competition.
2.6 The Promoter endeavors to deliver the prize to the winner within twenty eight (62) days from the date of winner confirmation, i.e. the date that the Promoter has managed to contact the winner and received confirmation of eligibility, unless otherwise specified. Delivery restrictions may apply.
2.7 No cash equivalent (where applicable) or alternative prize will be given and the prize is non-transferable and non-exchangeable. However, the Promoter reserves the right to change the prize due to circumstances beyond its control and/or to offer an alternative of similar value.
3. Data Protection
3.1 The Promoter (or any third party nominated by the Promoter) may exercise its sole discretion to use the winner’s (and (if applicable) their companion’s) name and image and their comments relating to the prize and competition experience for future promotional, marketing and publicity purposes in any media worldwide without notice or without any fee being paid.
3.2 Information and data ("personal data") which is provided by entrants when they enter will be held and used by the Promoter, ID Arena Ltd, Arnold Associates and their group of companies and their suppliers and contractors in order to administer the competition. Entrants’ personal data may also be passed to relevant regulatory bodies, the police or other authorities in the course of the investigation of any complaints or suspected unlawful activity or where requested by the phone provider in connection with the billing arrangements for the competition. Aggregate, non-personal data may also be used for the purpose of undertaking market research or in facilitating reviews, developments and improvements to relevant services.
4. Liability
4.1 Nothing in these terms and conditions restricts your statutory rights as a consumer. For more details on your statutory rights you should contact your local Trading Standards Office or Citizen's Advice Bureau.
4.2 Nothing in these terms and conditions shall exclude or limit the Promoter’s or ID Arena ltd and Arnold Associates group’s liability for death or personal injury caused by their staff or supplier’s negligence or for fraud.
4.3 Subject to clause 4.2, the Promoter does not accept responsibility for any fault, malfunction, damage, loss or disappointment suffered by any entrant howsoever arising from participating in the competition or of accepting any prize whether due to any error, omission or other cause by the Promoter, its employees, agents or others to the fullest extent permitted by law.
4.4 The Promoter is not responsible for any damage or loss caused to an entrant where such damage or loss is not reasonably foreseeable to the entrant and to the Promoter when the entrant agrees to these terms and conditions (which occurs automatically when you enter the competition), including where the damage or loss results from the Promoter’s breach of these terms and conditions.
4.5 The Promoter does not accept liability for any damage or loss caused to you where you are not entering into these terms and conditions as a consumer.
4.6 You agree not to give any indication that you have any commercial relationship with the Promoter, or that you are an agent of the Promoter or that the Promoter has endorsed any submission you may make in entering any competition.
4.7 The Promoter cannot promise that the services relating to the competition will be free from errors or omissions nor that they will be available uninterrupted and in a fully operating condition. These services may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons reasonably beyond the control of the Promoter. The Promoter will not be liable to you or to any other person in the event that all or any part of the service relating to the competition is discontinued, modified or changed in any way.
4.8 You agree to reimburse the Promoter in respect of any damages suffered by the Promoter or any losses by the Promoter resulting from any claim made by a third party in each case in respect of any matter arising from your use of the services relating to the competition in breach of these terms and conditions or from your violation of any applicable law or regulation.
5. Standard terms
5.1 In the event that any entrant does not, or is unable to, comply with and meet these terms and conditions, the Promoter shall be entitled at its sole discretion to disqualify such entrant, without any further liability to such entrant. Any entrant must comply with any directions given to him or her by the Promoter including but not limited to any and all relevant laws, rules and regulations.
5.2 In the event that any entrant does not, or is unable to, comply with and meet these terms and conditions, the Promoter shall be entitled at its sole discretion to disqualify such entrant, without any further liability to such entrant. Any entrant must comply with any directions given to him or her by the Promoter including but not limited to any and all relevant laws, rules and regulations.
